What is Mediation?Mediation is a voluntary form of alternative dispute resolution (ADR) in which the opposing parties act as direct decision makers. While each party may bring his or her own attorney, they may also appear unrepresented and utilize their attorney in an advisory capacity. The session is guided by a neutral mediator. At the close of mediation, agreements reached may then become part of divorce decrees or other binding documents or court orders concerning separation, child custody and child support, equitable distribution of property, prenuptial agreements, post-divorce issues, business contracts, educational plans, or employment matters. Mediation is a voluntary, confidential form of dispute resolution. Nothing you say in mediation to try to resolve your dispute can be later used as evidence in court. What is Arbitration?In arbitration, an independent party makes a binding decision for the opposing parties. It is highly recommended that each party be accompanied by an attorney. The process requires adherence to the same Rules of Evidence used in a courtroom proceeding, but the session is private, faster, and usually more cost-effective than courtroom litigation. Any decisions resulting from arbitration are presented to a judge for the entry of an enforceable final order. There is normally no appeals process available following arbitration.
